Congratulations on your purchase of a ZONEZ product. This Limited Warranty is provided for your protection. Any items not manufactured by ZONEZ in which we act as a reseller are covered under the original manufacturer’s warranties and are not covered by this limited warranty.  This limited warranty is only effective if, before shipment, you sign the ZONEZ Standard Terms and Conditions and pay for the product shipped in full. Please note that ZONEZ Standard Terms and Conditions are complimentary with this limited warranty. If any conflict arises between this document and the ZONEZ Standard Terms and Conditions, the Standard Terms and Conditions will control. Please mail or fax the fully completed, signed, and dated warranty activation document, including a fully filled out product questionnaire to ZONEZ at the address or fax number set forth below. Failure to meet any of the conditions above may modify or nullify the warranty rights granted under this Limited Warranty at the sole discretion of ZONEZ.

ZONEZ warrants the following products (either knockdown or preassembled by ZONEZ) (“Products”) to be in good working order under normal use for a period of ten (10) calendar years commencing from the date of its original purchase as a new product: (a) 4×4 Concentration Suite; (b) 8×4 Collaboration Suite; (c) 6×6 ADA Conversation Suite; (d) 10×10 Collaboration Suite. Assembly of the product shall be a period of (1) year. If a Product fails due to defects in material or workmanship during such period, ZONEZ will, at its option, either replace the defective portion of the Product, or the entire Product, or repair the Product, at no charge, so that the Product substantially functions for normal use as a whole based on normal custom and practice for the modular building industry. If the Product does not perform as warranted, you may call ZONEZ for available service options and the location of the authorized service representative nearest you.  To be covered by this Limited Warranty, however, the claim must be made within 72 hours of discovery by delivering written notice to ZONEZ. A certified letter or other methods to track the time and date of the notice is required. Failure to report the claim within this specified time period may void your warranty. Please note that a valid Return Authorization (RA) number must be issued by the ZONEZ customer service department for all returns. You must properly insure any returned Products and you bear all liability for loss of or damage to the Products during shipment.  You are responsible for all freight/ transportation charges for shipment of the Product to ZONEZ or its authorized service center.  Please include a copy of your dated purchase documents, the Product serial number, job number, or other information, and a detailed description of the problem you are experiencing.

If any labor, repair, or replacement is required because of accident, negligence, misuse, theft, vandalism, fire, water, or other peril or because of other conditions outside of ZONEZ web-based product specification publications, (www.zonez.com) including, but not limited to, electrical power, temperature, humidity or dust; or by moving, repair, relocation or alteration not performed by ZONEZ or by any cause other than normal use, ZONEZ’s limited warranty shall not apply. Material replacement charges, freight, travel, lodging, and per diem charges will be billed if onsite non-warranty work is required as a result of any of the problems set forth in this paragraph.

An out-of-warranty Product may be serviced through ZONEZ’s authorized service centers.  Please call ZONEZ at (800) 929-7702 for the location nearest you.

This warranty is valid only in the United States of America unless explicitly authorized in writing at the time of sale, or covered by an existing GSA contract for US government purchasers or US Government authorized purchasers.  Products taken outside of the United States of America are no longer eligible for warranty service unless covered under an existing GSA contract for US government or US Government authorized purchasers.

This Limited Warranty is valid only for the Product’s owner and is not valid for renters or lessees of the Product.  If the Product is sold before the expiration of this Limited Warranty, the Limited Warranty will remain valid only during the original warranty period.  Any subsequent owner of the Product must show proof of the first owner’s purchase of the Product and be in compliance with the terms of this limited warranty in order to obtain warranty service.

ZONEZ’S LIABILITY WITH RESPECT TO ANY PRODUCT SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THAT PRODUCT.  ZONEZ’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS LIMITED WARRANTY SHALL IN NO EVENT EXCEED THE AMOUNT YOU HAVE ACTUALLY PAID FOR ALL PRODUCTS PURCHASED FROM ZONEZ.  IN NO EVENT SHALL ZONEZ BE LIABLE FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, LOSS OF USE OR PROFITS, OR ANY OTHER SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR RELATED TO THIS DOCUMENT OR THE SALE, USE, OR PERFORMANCE OF THE PRODUCTS, HOWEVER, CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN AN ACTION FOR CONTRACT OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT ZONEZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITY OR DAMAGES. EXCEPT FOR THE WARRANTIES EXPRESSLY STATED IN THIS LIMITED WARRANTY, ZONEZ DOES NOT MAKE ANY WARRANTIES WITH RESPECT TO THE PRODUCT, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

This limited warranty shall be governed by and construed in accordance with the laws of the State of California. If for any reason a court of competent jurisdiction finds any provision or portion thereof, to be unenforceable, the remainder of this limited warranty shall continue in full force and effect. This limited warranty constitutes the entire agreement between the parties with respect to the products purchased and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment or modification of this warranty will be binding unless in writing and signed by an authorized officer of ZONEZ.
